However, no monitoring system can detect every potential failure, and our services do not guarantee that electrical failures, equipment damage, or safety incidents will not occur.

1. Service Limitations Disclaimer

CTM365’s continuous thermal monitoring services are designed to provide real-time temperature data and alert users to thermal anomalies that may indicate developing electrical issues. However, you acknowledge and agree that:

  • No monitoring system can detect 100% of potential electrical failures
  • Thermal monitoring may not identify all types of electrical faults (e.g., internal corrosion, vibration-related issues, or failures not accompanied by temperature changes)
  • False positives and false negatives can occur
  • Our service relies on proper sensor placement, environmental conditions, and communication networks
  • CTM365 is not a substitute for qualified electrical inspections, maintenance programs, or safety protocols

CTM365 does not guarantee that electrical failures, equipment damage, downtime, injuries, or property damage will be prevented. Our service is a risk reduction tool — not a guarantee of absolute safety or reliability.

CTM365 does not act as a certified electrical inspector, code official, or compliance auditor. Customers should engage qualified third parties for formal inspections and code compliance verification.

10. Limitation of Liability Disclaimer

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CTM365, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Equipment damage, property damage, or personal injury

This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability) and even if we were advised of the possibility of such damages. Our total aggregate liability shall not exceed the amount paid by you to CTM365 in the six months preceding the event giving rise to the claim.
